- In situations of irresponsible or unsafe or negligent usage, there could be discretionary exceptions to this policy, whereby you could be liable for all damages irrespective of whether or not we are able to claim insurance in such cases. Examples of such situation include, but are not limited to:
- When the User is not in compliance with the laws and/or with terms of Mahindra subscription-by the year’s User Agreement
- When the User is found to be under the influence of alcohol/narcotics while driving
- When the User is in violation of traffic rules or of the Motor Vehicles Act (for example, if the User has not paid the inter-state tax while crossing a state border)
- When the vehicle workshop and/or insurance company deem the damage to be consequential in nature (this will be clearly stated in the accident report). Consequential damage occurs when the User continues driving the car even when it is performing abnormally
- When the number of people in the car at the time of the incident exceed the standard seating capacity of the car
- When there is misrepresentation of information in the driving license and ID proof details shared by the user
- Where there is clear evidence of extremely rash and negligent driving on the user’s part.
- If you want to return the car before completing the usage period, you can do that too, but you will need to pay the “Accumulated Fee Difference” plus one month of fee. Accumulated fee difference means “monthly fee of your actual period of usage, minus the monthly fee of your originally selected usage period”, multiplied by the number of months of actual usage.
- For example, let’s take a car whose monthly fee is Rs 20,000 for a 24 month usage period, and Rs 22,000 for a 12 month usage period. Now, if you had originally opted for a usage period 24 months, but you return the car at the end of 12 months, the Accumulated Fee Difference would be Rs 2,000 (22,000 minus 20,000), multiplied by 12 = Rs 24,000. If you want to return the car before 12 months (the minimum usage period), a pre-closure penalty is applicable in addition to the Accumulated Fee Difference. Pre-closure penalty is 25% of the pending monthly fees until the completion of 12 months.
- Similarly, if you want to keep the car for longer than your usage period, you can do that too, and your monthly fee will be reduced to reflect the longer period of usage.
- If you return the car before completing the usage period, you will need to pay the “Accumulated Fee Difference” plus one month of fee. Exclusions under maintenance:
- Replacement and maintenance of non-standard accessories such as music system, speakers, antenna, wheel caps, side view mirrors, seat covers, mats, mud flaps, speakers, fog lamps, seat upholstery, etc.
- Repair due to damages caused by user negligence such as running on a flat tyre, not paying heed to oil warning lamp temperature gauge, usage of adulterated or non manufacturer specified standard fuels, consequential damage due to driving post accident, etc.
- Wear-and-tear (e.g., replacement of consumables such as tyres, clutch plates, brake pads and discs etc. much before their standard life is exhausted) Consequential damage due to non adherence of service schedule.
- Pollution Under Check certification and other statutory licenses/clearances as may be required from time to time
- To experience optimal performance from your car, we suggest that maintenance schedules, as prescribed by the manufacturer, be followed. Details on mileage and time schedules can be found in the Owner’s manual provided with your car. Often erratic/delayed maintenance schedules lead to damage to the car, which may also lead to cancellation of the warranty.
- Mechanical or electrical breakdown
- Battery problems: flat battery
- Key problems: locked keys, lost keys, or broken keys
- Road traffic accident where the car is immobilised.
- Small scratches with a depth of upto 1 mm, and small dents (up to 20mm in diameter) are normal. But scratches that have penetrated to the base coat of paint with visible signs of corrosion, or dents of above 20 mm diameter, will count as excessive wear and tear
- Stone chipping on the surface of headlights (not breaking the glass and not harming the function) is normal. But cracked/malfunctioning headlights will count as excessive wear and tear
- Seats showing general usage and mild de-colouration/lines are normal, but cigarette burns or torn upholstery will count as excessive wear and tear In all cases, we will assess such charges in a fair and transparent manner.
- Also, in case of unboxed car, any pre-existing scratch/dent (that it, a scratch or dent that was already there when the car was delivered to you), will not be counted as excessive wear and tear.
